Terms and conditions of Hire

1 Rental Charges Our listed hire prices are published as a guide only. Having placed and order with us, the hirer is liable to pay any fees upfront according to the terms stated (also see paragraph 3 below) Late payment may delay or prevent delivery, and may also give rise to additional administrative charges

2 Rental Period _________________ to _________________

All Bicycles and accessories must be returned or made available for collection on or before the time agreed. For each day or part day it remains outstanding the hirer may be charged the full day hire rate for each outstanding item, or the sum of direct and consequential losses attributed to its late or non return.

3 Cancellation

On Cancellation of an agreed rental: If we receive less than 24 hours notice of cancellation, you are liable for the whole of the agreed fee.

In the unprecedented event that we cannot fulfil an engagement, our liability is limited to the cost of arranging alternative hire, subject to a maximum of the fees we have agreed with you.

We cannot accept any liability for any direct or consequential losses. Our liability is also limited by giving you notice, in the same proportions, and applying the same periods we apply to your liability to us. (see above) and by force majeure.

Force Majeure

We will not be liable for any failure to supply a product or service where that failure is wholly caused by an event beyond our control that we could not reasonably anticipate, forestall or prevent.

This may include (but is not limited to) acts of war, terrorism, extreme weather conditions, or natural disasters. Where any public authority advises that only essential journeys should be undertaken, any product or service we supply shall not be considered essential.

Ownership

All hired equipment (bicycles, props and accessories) remain the property of the Dutch Bike Shop LTD.

A hirer may not sell, lease, lend, sub hire, modify or dispose of any equipment.

Where equipment is purchased by a hirer, ownership does not pass to the hirer until fully cleared payment has been received by the Dutch Bike Shop LTD.

Condition of equipment

Where equipment is used without our supervision, we check the condition and operation of all items before they leave us. Upon accepting delivery you agree the hired equipment is suitable for the purpose, and it is used safely and legally. Anyone appointed to operate or supervise equipment must be competent to do so. (and must have received any appropriate training where required by circumstance or law)

Equipment may only be used within the manufacturers guidelines

Any misuse of hired equipment by a hirer or hirer’s appointee entitles the Dutch Bike Shop to its immediate recovery without notice or penalty, and may result in further action if it has been tampered with or damaged.

Service and Repairs

No service, repair or non user adjustment (as determined by the manufacturer) may be attempted without the prior express consent of the Dutch Bike Shop Ltd.

Where user replaceable parts are fitted by a hirer, only manufacturer specified replacements may be used. Removal of covers or cover screws, in all cases ,invalidates the manufacturers warranty and the hirer is liable for the full cost of replacing equipment where evidence of such tampering is found.

Lost, stolen or damaged equipment

We cannot accept responsibility for crowd control or for the safety or security of any hirer’s or third party premises, and unless it arises from our own actions or negligence, a hirer is liable to us for the whole cost of any damages, theft or loss of our equipment. Including that resulting from any third party’s use of our equipment.

Equipment Failure

All the equipment we supply is safe, fully operational, and in good condition.

All our equipment is of a high standard and well maintained, catastrophic equipment failure is therefore unusual and unlikely.

However we cannot accept liability for any direct or consequential losses arising from equipment failure.

Exclusivity and variation

Other terms and conditions may apply to any agreement you have with us (wether or not they form any part of any written statement) and the above terms do not apply exclusively.

Any variation must be specifically agreed by the Dutch Bike Shop LTD in writing

These terms take priority over any agreement where no other written statement exists.

Security deposits

At our discretion we may take a security/damage deposit by credit/debit card prior to the commencement of the hire.

Cash or cheques will not normally be accepted for the deposit.

The security/damage deposit will be refunded to the same credit/debit card upon the safe return of all hired equipment.

The amount of the security/damage deposit will vary depending on what is being hired, but will be advised to the hirer, either when an enquiry is being made, or when a booking is confirmed.

The amount of the deposit is arbitrary and does not limit your liability, which is for the full replacement of cost or any loss, or any cost incurred by us in repairing/replacing equipment that has been damaged or lost during the hire period.

If for any reason a security/damage deposit is not taken from a credit/debit card prior to the equipment being made available for hire, then any loss or damage incurred during the hire period will be debited from the same card that was used for payment of the hire fees.

If this is not possible we may debit the card that was originally used to pay the deposit to confirm the booking.

If we are unable to obtain payment from any of the debit/credit cards supplied to us for this purpose, then we reserve the right to issue legal proceedings against the hirer for default.

Should this be necessary, a court judgement may be obtained and registered against them which will make it far more difficult for them to obtain credit in the future.

I have read and agreed to the above terms and conditions:
