These Terms and Conditions govern your use of www.dutchbikeshop.ie and your relationship with www.dutchbikeshop.ie (“www.dutchbikeshop.ie“, “we” or “us”). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use on www.dutchbikeshop.ie. The dutchbikeshop.ie site is provided to you free of charge for your personal use and by using it you agree to be bound by these Terms and Conditions. These Terms and Conditions do not affect your statutory rights.
When you register with www.dutchbikeshop.ie you must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of changes to the information that you provided when registering by updating your personal details in the View Account section.
When you register to use www.dutchbikeshop.ie we will ask you for a password. You must keep this password secret and must not let anyone else use it. You are responsible for all activities and orders that are submitted using your password. If you think anyone else has your password, please inform us immediately.
www.dutchbikeshop.ie reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you. You can cancel this agreement at any time by emailing firstname.lastname@example.org.

Acceptance of your order
There will be no contract of any kind between you and www.dutchbikeshop.ie unless we dispatch the products to you. Your order (including payment) is an offer to buy from us, so nothing we do or say will amount to any acceptance of that offer until we send the product to you. At any point up until then, we may decide not to send the products to you and to give you a full refund. We will notify you if an item is out of stock and, unless you then request that your payment be returned, we will hold your payment until the product is next in stock. Goods are dispatched when (not before) a contract is made between you and us.
Where there is evidence of fraudulent use of credit cards or funds, www.dutchbikeshop.ie reserves the right to make orders void and withhold goods pending the outcome of any subsequent investigation.
Delivery and charges
The cost of packing and delivery is clearly displayed at checkout for your approval prior to confirming your order.
We usually ship within 24 hours of clearance of funds which means you should have your package within 2-10 working days if you live in Ireland. Delivery to the UK and Europe generally takes 3-14 working days, while you should allow 7-28 working days if you live outside the European Union. If we cannot deliver your goods within the agreed time we will inform you immediately and arrange another time for delivery. Reasonable allowance should be made for orders made over the weekend or national holidays.
We shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.
Where items have a greater lead time, the estimated lead time will be stated clearly in the product description.
We are not responsible for gift certificates that are not received due to your failure to provide us with accurate delivery information, such as an incorrect or non-existent email address.
Prices and VAT (sales tax)
Depending upon your choice of currency, our prices are stated in Euro (€) or Pounds Sterling (£) and show the product prices inclusive of VAT at the rate of 21%. If you are eligible for Irish tax free shopping, the sales tax (VAT) will be deducted during checkout. If you are eligible for a VAT refund please email us at email@example.com when you place your order.
When ordering goods from www.dutchbikeshop.ie for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from www.dutchbikeshop.ie, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

We clearly display the price you have to pay for our products. If we have accidentally underpriced a product, we will not be obliged to deliver that product to you at the stated price, provided we notify you before posting the product. You can then decide if you still want to proceed with your purchase.
You can buy gift certificates only at full value (including vat) and cannot pay for them using promotional offers or codes. Once you purchase a gift certificate we will email it to the recipient and you cannot cancel it.
If you have received a gift certificate, you cannot transfer it to anyone else or use it to purchase other gift certificates. You can use it only to make purchases up to the value of the gift certificate (if your purchase is over the value of the gift certificate, you must pay the additional amount). You cannot use our gift certificates anywhere other than in our shop or online at www.dutchbikeshop.ie. When you use your gift certificate, you will be able to use the value in whole or part, and in conjunction with any promotional offers or codes applicable to the goods which you are buying.
When a gift certificate is used on www.dutchbikeshop.ie we check only the gift certificate code and assume the gift certificate is being used by the recipient. Once you have received a gift certificate, please ensure that it is not used to make unauthorised purchases.
Cancellation and return
When you buy from www.dutchbikeshop.ie you have a right to return the goods or cancel the service within a seven day “cooling-off” period. Simply contact us by telephone, email or post to arrange this. You must pay the cost of return postage. If your order is a gift certificate, you cannot cancel it because it will already have been emailed to the recipient. If you have any questions about the goods or need help on deciding whether to keep them, please contact firstname.lastname@example.org for more information.
If the products have already been posted to you (or on your behalf to any other person), you (or the other person) must return the products to us at the time of cancellation and we will credit your credit or debit card with the price of the products, minus all the shipping and handling charges, within 30 days, beginning with the day on which notice of cancellation was given. If you paid by gift certificate, we will provide you with a new gift certificate.
You should return products to The Dutch Bike Shop, 22 Hansted Cresent, Finnstown, Lucan, Co Dublin, Ireland, enclosing a copy of the original invoice. When returning goods we recommend that you use recorded delivery or obtain a proof of postage (which can be obtained free of charge at any post office).
If you do not return the goods within seven days of your cancellation, we will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the website.
Any damaged or defective items would be replaced without charge and the cost of return postage refunded. Please provide a receipt and retain proof of postage. You should inspect the item as soon as it arrives and if it is damaged you must contact us immediately and we will rectify the problem for you.
Availability of www.dutchbikeshop.ie
We value your custom and we want to offer you the best possible service. However, we cannot promise that all our products and services will meet your requirements, and we cannot guarantee that the website, www.dutchbikeshop.ie will be fault-free. If you find a fault, please let us know by emailing email@example.com.
We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Occasionally, your access to the website may be temporarily suspended or restricted to allow for repairs, maintenance or upgrades. We will attempt to limit the frequency and duration of any such suspension or restriction.

- www.dutchbikeshop.ie is not liable for any indirect damage to You or third parties, including consequential damage, loss in turnover and profit, loss of data and emotional injury, connected to or resulting from the Agreement or use of the Products.
- Nothing in this paragraph applies to liability in respect of products sold through www.dutchbikeshop.ie.
- Nothing in these Terms and Conditions excludes liability for death or personal injury caused by our negligence or fraud.
Your satisfaction is of utmost importance to us. We aim to deal with any complaints effectively, discretely and in a fair and swift manner. Any complaints should be directed to firstname.lastname@example.org and should include your contact details, email address and order number, where appropriate.
We may update these Terms and Conditions from time to time and any changes will be notified to you via a suitable announcement on www.dutchbikeshop.ie. We collect information about you for two reasons: firstly, to process your order and secondly to provide you with the best possible service.
We will not email you in future about our products and offers if you choose to opt out (to opt out, email us at email@example.com).
All the information collected on this site will be kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned. We will never send you third-party marketing material. We want to provide you the best and easiest online shopping experience possible. In order to do this we need to gather certain pieces of information from you. We ask for your email address and password when you register on the site. You will not need to re-enter your name and address when you return to the site at a later date. We use your email address to confirm your order and to keep you informed of the progress of your order. The only other occasion when www.dutchbikeshop.ie will use your email address is, with your permission, to send you from time to time further information on products and special offers. You do have the option to opt out of receiving our email newsletter at any time.
The type of information we will collect about you includes: name, address, email, phone number, gender, credit/debit card. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or amend them promptly. You can usually modify your browser settings to prevent this happening. The information collected in this way can be used to identify you for the purpose of providing a more personalised service and enhancing your shopping experience.
Reviews, comments, communications and other content

www.dutchbikeshop.ie will not be held responsible for any negligent use or misuse of products purchased from www.dutchbikeshop.ie. Nothing in these guidelines should be thought to supersede, alter or take precedence over manufacturers’ instructions.
By purchasing any product from www.dutchbikeshop.ie, I understand and acknowledge that I am under no obligation to follow any recommendations made by the seller. I understand any information received is intended to help me make an informed decision. I assume the risk of any adverse effects or consequences resulting from the use or misuse of any of the suggestions, preparations, or procedures. I hereby release, hold harmless, and discharge www.dutchbikeshop.ie and all of its officers, employees, agents and suppliers from all claims of damages, demands, or actions whatsoever in any manner arising from or growing out of my participation.
These Terms and Conditions shall be governed by Irish law and the courts of Ireland should have exclusive jurisdiction to settle any disputes that arise out of or in relation to them. The Dutch Bike Shop Ltd accepts no liability under the law in any jurisdiction other than the Republic of Ireland. Any contracts between you and us are concluded in English.
If any of these Terms and Conditions are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If you breach these Terms and Conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
We shall not be liable for any breach of these Terms and Conditions beyond our reasonable control.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions, but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
